The European Commision announed <<the opening of an anti-dumping process concerning certain Turkish products such as hot rolled, iron, alloyed and non-alloyed steel plates imported in the Union, in response to a complaint from Eurofer>>.

These products are actually classified with codes NC 7208 10 00, 7208 25 00, 7208 26 00, 7208 27 00, 7208 36 00, 7208 37 00, 7208 38 00, 7208 39 00, 7208 40 00, 7208 52 10, 7208 52 99, 7208 53 10, 7208 53 90, 7208 54 00, 7211 13 00, 7211 14 00, 7211 19 00, ex 7225 19 10 (code TARIC 7225 19 10 90), 7225 30 90, ex 7225 40 60 (code TARIC 7225 40 60 90), 7225 40 90, ex 7226 19 10 (code TARIC 7226 19 10 90), 7226 91 91 e 7226 91 99.

Eurofer <<claimed that the import of these products were submitted to the enrolment in order to apply retroactive duties from the registration date>> and <<actually, the European Commission have sufficient evidence to demonstrate that Turkish products are subject to dumping>>.

The same Commission concluded that <<there are sufficient evidence to excuse the enrolment for the import of product concerned>> with the aim of ensuring <<the establishment of anti-dumping duties in case it should emerged the necessity at the end of investigation, these duties could be retroactive on registered import, as long as the necessary conditions will be satisfied according to the legal provisions applied>>.

Note that <<in accordance to the complaint which led to the opening of anti-dumping investigation, for the product concerned the dumping limits estimated are between 4% and 8% and the injury elimination levels range from 10% and 25%>>. The duties amount which could be collected in the future <<can be estimated to the highest dumping limit reported on complaint, meaning 8%>>.

Eurofer, obviously, has <<accepted the enrolment for Turkish import of hot rolled steel. This might results in the application of retroactive anti-dumping duties normally planned for January 2021. The enrolment avoid opportunistic import peaks before the imposition of following duties. Basically, since 14th November 2020 all import in EU from Turkey may be subject to anti-dumping duties in the future>>.

According to Axel Eggert, the Managing Director of Eurofer <<the anti-dumping practices are slow and require long time to be implemented. Even if the investigation of fourteen months is in progress, imports will stay volatile and they should rapidly condition the EU’s market. So the enrolment is an essential instrument to guarantee the efficiency for the commercial defens of EU>>
